This Privacy Policy describes how SILO ("Company," "we," "us," or "our"), an India-based company, collects, uses, discloses, and protects personal data when you visit our websites (including silos3.com and related subdomains), use our applications, or interact with our distributed cloud storage services (collectively, the "Services").

Our Services connect customers seeking storage ("Customers") with independent storage providers operating nodes on our network ("Storage Providers"). Customer data stored through the Services ("Storage Materials") is encrypted end-to-end. SILO and Storage Providers cannot access the content of encrypted Storage Materials.

When we process Storage Materials on behalf of Customers, we act as a data processor (or data fiduciary under applicable Indian law, where relevant). Individuals whose personal data may be included in Storage Materials should contact the relevant Customer. When you provide account, billing, or contact information directly to SILO, we act as the data controller/fiduciary for that information.

By using the Services, you accept this Privacy Policy and our Terms of Use, Terms of Service, and Storage Provider Terms and Conditions (collectively, the "Agreements").

1. Information We Collect

Information you provide. We collect information you provide directly, such as when you create an account, subscribe to updates, contact support, participate in community forums, or complete forms. This may include your name, email address, username, password, billing details processed by payment partners, wallet or payout addresses (for Storage Providers), tax identifiers where required, survey responses, and other information you choose to provide.

Information collected automatically. When you use our Services, we may automatically collect log data (IP address, access times, pages viewed, referring URL), device information (hardware model, operating system, browser type, device identifiers), approximate location inferred from IP address, telemetry about storage node performance (for Storage Providers), and usage metadata about how the Services are accessed (such as shard counts, transfer volumes, and authentication events). We do not use this metadata to decrypt or inspect Storage Materials.

Cookies and similar technologies. We use cookies, web beacons, and analytics tools to operate and improve our websites. See Section 5 below.

2. How We Use Information

We use personal data to:

  • Provide, maintain, secure, and improve the Services;
  • Create and manage accounts and process payments;
  • Respond to support requests and communicate about the Services;
  • Send service, security, and administrative messages;
  • Monitor usage, detect fraud, and enforce our Agreements;
  • Comply with applicable law and respond to lawful requests; and
  • Carry out any other purpose disclosed at collection or with your consent.

We may combine information collected through the Services with information from other sources, subject to this Privacy Policy.

3. Legal Bases for Processing

We process personal data where:

  • Processing is necessary to perform our contract with you (including the Agreements);
  • Processing is necessary for our legitimate interests (such as securing the Services, preventing abuse, and improving performance), balanced against your rights;
  • Processing is required to comply with legal obligations under Indian law, including the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 ("DPDP Act"), as applicable; or
  • You have given consent, where consent is required.

4. Sharing of Information

We may share personal data:

  • With service providers who perform work on our behalf (hosting, analytics, payment processing, email delivery);
  • When you use public areas of the Services (forums, blogs), information you choose to share may be visible to others;
  • To comply with law, regulation, legal process, or government request;
  • To protect the rights, property, or safety of SILO, our users, or others;
  • In connection with a merger, acquisition, financing, or sale of assets; and
  • With your consent or at your direction.

We do not sell personal data. We do not share personal data with third parties for their independent direct marketing without your consent.

5. Cookies and Analytics

We use first- and third-party cookies and analytics tools to understand site traffic, improve user experience, and measure marketing effectiveness. You can control cookies through your browser settings. Disabling cookies may limit certain features.

Where required by applicable law, we obtain consent before placing non-essential cookies. Session and analytics data may be aggregated and is not always attributed to individual visitors.

6. International Data Transfers

SILO is based in India. If you access the Services from outside India, your information may be transferred to, stored in, or processed in India and other countries where we or our service providers operate. We implement appropriate safeguards for cross-border transfers as required by applicable law, including contractual protections where necessary.

7. Your Rights (India)

Subject to applicable law, including the DPDP Act, you may have the right to:

  • Access personal data we hold about you;
  • Request correction or updating of inaccurate or incomplete data;
  • Request erasure of personal data, subject to legal retention requirements;
  • Withdraw consent where processing is consent-based;
  • Nominate another individual to exercise your rights in the event of death or incapacity, as permitted by law; and
  • Lodge a grievance with us or with the Data Protection Board of India, as applicable.

Marketing communications. You may opt out of promotional emails using the unsubscribe link in those messages. You cannot opt out of essential service or transactional communications.

8. Data Retention

We retain personal data for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our Agreements. Retention periods vary depending on the type of data and our legal requirements under Indian law.

9. Security

We use administrative, technical, and organizational measures designed to protect personal data against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure. You are responsible for maintaining the confidentiality of your account credentials and encryption keys.

10. Third-Party Links and Services

The Services may contain links to third-party websites or integrate third-party tools. SILO is not responsible for the privacy practices of third parties. We encourage you to review their privacy policies before providing information to them.

11. Children's Privacy

The Services are not directed to children. We do not knowingly collect personal data from individuals below the age permitted under applicable Indian law without appropriate parental or guardian consent. 12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page and update the "Last updated" date. Material changes may be communicated by email or in-product notice where required by law. Continued use of the Services after changes become effective constitutes acceptance of the updated policy.
